Public Offer for the Sale of Digital Products

1.General provisions

1. This offer governs the relationship between the Seller and a natural or legal person (hereinafter the Buyer) regarding the purchase of digital information products via the website eccs.com.ua (hereinafter the Website).
2. Acceptance of the offer is deemed to occur when the Buyer places an order and pays for it. From the moment of acceptance the contract is considered concluded and these terms binding on the parties.
3. The parties' relationship is governed by the laws of Ukraine, in particular the Law of Ukraine “On Digital Content and Digital Services” and the Law of Ukraine “On Consumer Protection” No. 3153-IX of 10 June 2023 (to the extent not covered by the former), as well as the Civil Code of Ukraine.

2.Definitions

• Digital product — an information product in electronic form (guide, self-study course, template, checklist, presentation, collection of materials, etc.) supplied as a file (PDF or another format) or as access to it, without a tangible medium.
• Order — a duly placed request by the Buyer on the Website to purchase one or more Digital products.
• Personal access — sending the file and/or a download link to the Buyer's email, or granting access by other electronic means.

3.Subject of the contract

1. The Seller undertakes to provide the Buyer with a Digital product, and the Buyer undertakes to accept and pay for it on the terms of this offer.
2. The name, contents, format and price of a specific Digital product are set out on the relevant product page on the Website at the time the Order is placed.
3. The range of Digital products may be changed and expanded by the Seller without separate notice.

4.Price and payment

1. Prices for Digital products are shown on the Website in Ukrainian hryvnia and include all applicable taxes and charges.
2. Payment is made online — by a credit transfer to the specified account details (IBAN) through the relevant payment service, or by another method available on the Website. Payment is confirmed in the Buyer's banking app; the Seller does not receive or store the Buyer's payment card details.
3. The Buyer's payment obligation is deemed fulfilled from the moment the funds are credited or the Seller receives confirmation of successful payment.

5.Delivery of the product

1. The Digital product is provided to the Buyer in electronic form promptly after payment is confirmed — by sending the file and/or a download link to the email address specified by the Buyer, and/or granting access on the Website.
2. The Buyer must provide a valid email address. The Seller is not liable for non-delivery caused by an incorrect address, a full mailbox, or the Buyer's spam filtering.
3. If the product has not arrived within a reasonable time for technical reasons, the Buyer contacts the Seller using the details in Section 13, and the product is provided again.

6.Right of withdrawal and refunds

1. Given the nature of digital content, no refund is made for a properly supplied Digital product to which access has already been granted.
2. A refund is possible if: the product was not provided to the Buyer through the Seller's fault and the issue was not resolved after contact; a product not matching the Website description was provided; or in other cases expressly provided by law.
3. To have a refund considered, the Buyer sends a request to the Seller's email with the order number and a description of the situation. The Seller reviews the request and communicates its decision within the period established by law.

7.Intellectual property and licence

1. All Digital products are protected by copyright. The economic rights belong to the Seller or are used by it on lawful grounds.
2. Upon payment, the Buyer receives a non-exclusive licence to use the Digital product solely for their own personal (non-commercial) needs.
3. It is prohibited to copy, reproduce, distribute, publish, transfer to third parties, resell or otherwise commercially use the Digital product, in whole or in part, without the Seller's written permission.
4. Breach of the licence terms gives rise to liability under the copyright laws of Ukraine.

8.Nature of the information and liability

1. Digital products are of an informational and reference nature, reflect data current as at the date of purchase, and do not constitute individual tax, legal or other professional advice.
2. Legislation, rates, limits and procedures may change; the Buyer independently verifies the information's currency before relying on it.
3. The Seller does not guarantee that the Buyer will achieve any particular results and is not liable for the Buyer's decisions, actions or omissions made on the basis of the Digital product's materials.
4. For individual matters, the Buyer may request a separate consulting service from the Seller.

9.Personal data

1. By placing an Order, the Buyer consents to the processing of their personal data (name, email, phone number) for the purpose of performing the contract.
2. Processing is carried out in accordance with the Privacy Policy posted on the Website and the personal-data protection laws of Ukraine.

10.Force majeure

The parties are released from liability for non-performance of their obligations if it is caused by force-majeure circumstances, including hostilities, decisions of public authorities, or power or communication outages, confirmed in the established manner.

11.Term and changes to the terms

1. The offer is effective from the moment it is posted on the Website until revoked by the Seller.
2. The Seller may amend the terms of the offer. A new version takes effect once posted on the Website and applies to orders placed thereafter.
3. The version of the offer in force at the time an Order is placed applies to that Order.

12.Dispute resolution

1. The parties resolve disputes through negotiation. Failing agreement, a dispute is resolved in the manner established by the laws of Ukraine.
2. The substantive law of Ukraine applies to this contract.
